INLAND WETLANDS/CONSERVATION COMMISSION


Minutes                                 - 1 -                                   December 4, 2013

THE FOLLOWING ARE MOTIONS MADE DURING THE REGULAR MEETING OF THE INLAND WETLANDS AGENCY/ CONSERVATION COMMISSION – MADDEN ROOM

Chairperson Warren called the meeting to order at 7:00 pm

PUBLIC PARTICIPATION:

Peter DeMallie, representing Folsom Construction, requested a special meeting be set to hear an application for Folsom’s relocation to 595 Nutmeg Road North.

Motion to:  set a special meeting on January 8, 2014 to hear application from Folsom Construction for property located at 595 Nutmeg Road North, provided that the application has been received by town staff no later than December 13, 2013, allowing it to be received by the Commission at the December 18, 2013 meeting.

The motion carried and the vote was unanimous.  

PERMIT EXTENSIONS:  none
CORRESPONDENCE AND REPORTS:   Chair Warren initiated a discussion regarding a request for support for updating Connecticut’s Bottle Bill to include more types of beverages then originally covered when created in 1980.  The consensus was that support should come from individuals not the Commission as a whole.

BONDS:  none
MINUTES:  11/20/2013, approved by consensus.

CONSERVATION COMMISSION:  The King Street property has been acquired for open space.

WETLAND OFFICER’S REPORT:  none

PUBLIC HEARING:  none

NEW BUSINESS:

Appl.# 13-51P - Distinctive Gardens & Tree Care LLC – 48 Patria Road – Inland Wetland/Conservation Commission application for the restoration of impacted wetlands and the construction of a materials and equipment storage yard on property located northerly of Patria Road, Industrial (I) Zone.

Dean Gustafson, Professional Soil Scientist with All-Points Technology, presented the application.  Mr. Gustafson stated that the applicant wants to add an undeveloped parcel to the abutting parcel he currently owns, to add storage area for his business and to satisfy an existing violation from the previous owner.  A restoration plan is proposed to replant two areas of wetlands in the center of the property with native plantings and a wetland seed mix.  The upland review area will be restored for habitat – cover and food for native species.  In order to not disturb the wetlands any further, the plantings will be done by hand as the applicant has the expertise and manpower.  The existing ruts from travel in and out of the property will be filled in with castings from the ruts.

Motion to:  approve appl. #13-51P, with the following conditions:

  • The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
  • The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
  • The permit is valid for five years and shall expire on December 4, 2018.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.
  • A bond shall be collected in the amount of $2,000 to ensure adequate erosion and sediment controls are constructed and maintained through the construction process.  A bond shall be collected in the amount of $5,000 for the establishment of the proposed stormwater structures.  A bond shall be collected in the amount of $3,000 for the establishment and maintenance of the proposed habitat plantings.  The planting bond will be held for two growing seasons with an annual report submitted to the Town by the environmental consultant on the status of the growth of the plantings.
  • All approvals required must be obtained and submitted prior to any activity on the site.
  • A contact person shall be identified on the plans.
